Welcome to Damia Mall. By using this platform as a seller or buyer, you agree to comply with the following Terms & Conditions. Please read them carefully before registering, uploading content, or trading with any party on this platform.

1. KYC (Know Your Customer) Requirements

To ensure compliance, safety, and transparency, all sellers must complete full KYC verification before listing products or receiving approval.

The mandatory documents include:

• A clear **passport photo**
• A valid **government-issued ID photo** (front and back)
• A recent **profile/self photo**

Failure to provide valid documents may lead to verification failure, a request for resubmission, suspension, or refusal of approval.

2. Seller Responsibilities & Anti-Fraud Policy

All sellers must uphold honesty, integrity, and professionalism. The following acts are strictly prohibited:

• Conmanship, fraud, false advertising, or deceitful practices
• Selling fake products or misrepresenting item condition
• Failing to deliver paid-for products without valid reason

If a seller engages in any fraudulent act, they bear full responsibility for all resulting consequences, including legal action, account suspension, or permanent removal.

3. Buyer Responsibilities

Clients must also comply with honesty and ethical trading. Buyers are prohibited from:

• Initiating fraudulent disputes
• Reversing payments without cause
• Engaging in abusive or deceptive behavior toward sellers

Any breach may result in account restriction or termination.

4. Compliance With KRYSN Regulations

All users agree to comply with the rules and guidelines set by KRYSN (Kenya Regulatory & Safety Network) relating to online marketplaces. Violations—whether intentional or not—are fully the responsibility of the user involved.

5. Content Restrictions

Users must not upload, post, or distribute any of the following:

• Violent, graphic, or harmful images or videos
• Sexually inappropriate, explicit, or adult content
• Hate speech, abusive language, or harassment
• Illegal items, banned materials, or dangerous goods

All uploaded content is reviewed and must meet community and legal standards.

6. Approval, Moderation & Revocation

Platform approval is not permanent. Damia Mall reserves the right to:

• Approve or reject seller accounts based on eligibility
• Request additional verification documents
• Suspend or revoke an account that violates any rule
• Remove inappropriate or misleading content

Repeated violations may result in permanent banning from the platform.

7. Liability Disclaimer

Each user—buyer or seller—is solely responsible for their actions, listings, transactions, and communications. Damia Mall is not liable for:

• Losses incurred due to fraudulent behavior by any user
• Disputes between sellers and buyers
• Incorrect or falsified information provided during KYC
• External transactions conducted outside the platform

Users must trade responsibly and verify the legitimacy of all parties they interact with.

8. Agreement

By using Damia Mall, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. Continued use of the platform constitutes acceptance of any future updates to this document.
